Ticketing Conditions
1. By purchasing a ticket through QTIX you agree to these conditions (Ticketing Conditions). QTIX is the ticketing agency wholly owned by the Queensland Performing Arts Trust trading as Queensland Performing Arts Centre (QPAC) ABN 13 967 571 128.
2. Refunds and exchanges are only available in the limited circumstances set out in paragraph 13 of these Ticketing Conditions. Paragraph 14 sets out the circumstances when a refund or exchange will not apply. Please ensure you are happy with your purchase before you place your order.
3. Tickets are provided by QTIX as agent for the organisation(s) which are providing the event (Presenter). Subject to these Conditions, the Presenter, and not QTIX, is responsible for delivering the event to you.
4. You can find the name of the Presenter and/or the venue where the event will take place (Venue) on your ticket, but they are also available from QTIX.
5. You must also follow the Venue’s conditions of entry (Venue Conditions). They also form part these Ticketing Conditions. The Venue Conditions are available online or you can ask QTIX for a copy.
Payment and Prices
6. Tickets are only valid if sold or provided through QTIX, the Venue or other authorised agent. Tickets that are sold or resold in other ways, or obtained by fraudulent means, will not be valid and can be cancelled by QTIX at any time, without refund.
7. Ticket proceeds are held in a separate trust account and will be refunded if the event does not proceed.
8. Before you buy your tickets, prices are subject to change at any time. For some events, dynamic pricing and/or temporary discounts are applied, and in such cases, this may mean that you purchase tickets at a time when the price is higher.
9. Transaction fees or other fees may also apply. You will be made aware of the ticket prices and any other fees and charges before you place your order.
10. If the amount you pay for your ticket is incorrect, for any reason, QTIX may cancel the ticket and refund the amount that you paid. QTIX may offer a replacement ticket to you at the correct price.
Lost or Stolen Tickets
11. Where tickets are lost, stolen, misplaced or destroyed, QTIX may require proof of identity and purchase, prior to issuing a replacement ticket.
12. QTIX may not provide replacement tickets where tickets are for general admission rather than allocated seating.
Refunds and Exchanges
13. If the event is cancelled, rescheduled, significantly relocated or is materially different to how it was advertised, you will be entitled to a refund or exchange.
14. Unless paragraph 13 applies, you will not be entitled to a refund or exchange and must not dispute the transaction with any credit card provider, bank or financial institution, including in any of the following circumstances:
- change of cast members including use of understudy
- temporary event stop or technical glitch that is corrected in a reasonable time
- change in support act for a music event
- you or others are unable to attend the event or leave the event for whatever reason, including, for example because:
- you or others become ill
- you do not enjoy the show
- unforeseen circumstances require you to be elsewhere
- the show is not what you expected
- you miss the show or part of it because you arrive late e.g. travel delays
- other personal reasons
- tickets have been resold/purchased through an unauthorised route e.g. Viagogo
- tickets for the event subsequently become cheaper e.g. due to dynamic pricing or discounts or promotions
- tickets were purchased using a stolen credit card or by another fraudulent way
- you are denied entry or asked to leave the Venue because you fail to comply with the Venue Conditions
- you are denied entry to the Venue because you cannot produce your ticket or you cannot provide satisfactory evidence of an entitlement to a concession
15. In cases where you are not entitled to a refund or exchange under paragraph 13, the Presenter may still be prepared to provide you with a refund or exchange. In such cases, a refund or exchange is entirely at the discretion of the Presenter (i.e. not QTIX) and you may be required to provide supporting documentation.
If the Presenter does agree to provide a refund or exchange, even though they are not obliged to do so:
- you must pay a refund/exchange fee
- for an exchange:
- where the ticket price of the new ticket is higher, you must pay the difference
- where the ticket price of the new ticket is the same or lower, you will not be entitled to a refund of the difference
- seats which are the same or similar to the ones you initially purchased may not be available
16. You will not be entitled to reimbursement of auxiliary expenses (such as the cost of travel, car-parking, child-care, accommodation), even in the case that you receive a refund or exchange of your ticket. For this reason, you should consider buying ticket and/or travel insurance for those expenses.
Companion Card Tickets
17. If you require the assistance of a carer during the event, you may be entitled to an additional free ticket for them to join you (Companion Ticket). Your entitlement to receive a Companion Ticket and the applicable terms and conditions can be found at qpac.com.au.
Gift Certificates
18. Additional terms and conditions apply to the purchase of Gift certificates. Gift certificates Terms and Conditions are available at qpac.com.au.
Friends of QPAC
19. Additional terms and conditions apply to the purchase of Friends of QPAC Membership. Those additional terms and conditions are available at qpac.com.au
Privacy
20. By purchasing a ticket through QTIX, you consent to the collection, use, disclosure and handling of your personal information as detailed in QTIX’s privacy policy available at qpac.com.au
21. Where your personal information is provided to the Presenter and/or the Venue, the privacy policies of those organisations will also apply. You can find those documents online.
General
22. These Ticketing Conditions are subject to the Live Performance Australia Ticketing (Consumer) Code of Practice and Australian Consumer Law.
23. If any part of these Ticketing Conditions is held to be invalid, illegal or unenforceable, it will be disregarded to the extent of its invalidity and the remainder of these Ticketing Conditions will remain in full force and effect.
24. These Ticketing Conditions are governed by the laws of Queensland, Australia.
